Business Visas for Australia

Business visas can be short-term, provisional or permanent. Employer Sponsored Visas for Australia
This visa category - inclusive of all its subclasses - is designed for employers to be able to recruit personnel with skills, experience or qualifications in occupations that are needed in Australia.
Employers who have been unable to fill their recruitment needs from the Australian labour market or their own training efforts can employ highly skilled workers (both overseas or temporarily in Australia) through one of the 3 programs:
  • Employer Nomination Scheme (ENS)
  • Regional Sponsored Migration Scheme (RSMS) or
  • Labour Agreements (LAs)
A fourth program, Invest Australia Supported Skills (IASS) enables employers who have an approved IASS agreement to transfer key managerial and specialist employees of their company to Australia.
If you wish to apply for any of these visas, you will need to be sponsored by your employer and posses vocational English skills, or if applying under regional arrangements, functional English skills.
You may need assessment, depending on your occupation and other conditions. You can be in Australia or overseas at the time you apply. If you have already applied for a visa, and are then nominated by the sponsoring employer, you may or may not need another visa application depending on which visa you have applied for.

Student Visas for Australia

Student Visa Conditions
 
You must comply with the visa conditions for attendance and academic performance which come into effect after you have entered Australia. Compliance with your visa conditions is particularly important in order to avoid visa cancellation.

To be eligible for a student visa, you need to fulfil the following conditions:
  • Do not enter employment unless you have been granted permission to do so
  • Satisfy attendance and course requirements and maintain a valid enrolment for your course
  • Maintain your Overseas Student Health Cover (OSHC) while in Australia for yourself and family unit members accompanying you
  • Leave Australia before your visa expires
  • Remain with the education provider you originally enrolled with for the first 6 months of your course or, if the course is less than 6 months, for the duration of your course
  • Inform your education provider of your residential address within 7 days of your arrival in Australia. Communicate any changes in address within 7 days
  • If you change your education provider, you must inform your current education provider within 7 days of issue of an Electronic Confirmation of Enrolment (eCoE)
  • If you are an unaccompanied student applicant under 18 years of age, you must acquire written approval of your education provider before you change your address, support and welfare arrangements in Australia

Assessment Levels for Student Visas
 
Assessment level of each applicant is determined by a combination of assessment level of the country of residence and the visa subclass (corresponding to course of study) chosen.
Using this mechanism, each applicant is assigned an assessment level using a scale of 1 to 5 where assessment level 1 represents the lowest assessment rank and assessment level 5 the highest.
The higher the assessment level, the more evidence you need to provide to demonstrate your financial capacity and understanding of the English language.
If you have an assessment level 2, 3, 4 or 5, then you must make your first student visa application while you are outside Australia.
If you are applying from outside Australia and your visa application is assessed at assessment level 3, 4 or 5, you must provide:
  • 'Offer of a place in a course' letter from your Australian education provider at the time you submit your application
  • Electronic confirmation of enrolment certificate issued by your education provider after you submit your application (if you are requested by the Australian overseas mission to do so)
If you are applying outside Australia in Assessment Level 1 or 2, or in Australia in any Assessment Level, an electronic confirmation of Certificate of Enrolment (CoE) is required before you submit your application. You must submit a copy of CoE with your application.
If you are sponsored by AusAID or Defence and are applying for a subclass AusAID/Defence student visa, you will be subject to Assessment Level 2.

Note: A letter of offer is acceptable when an applicant submits an application within Australia, but they must have a CoE for grant of a student visa application.

Evidentiary Requirements
 
The factors that determine your eligibility evidence for student visa are:
  • Your capacity to bear the cost of air fares, course fees and living expenses for the duration of your stay in Australia
  • Your capacity to bear the costs of air fares, living expenses and school tuition charges for your family unit members for the duration of your stay in Australia
  • Your level of English Language Proficiency in relation to that required for your assessment level and education sector of study
  • The circumstances in your home country, e.g. personal or financial commitments that may prompt you to return to your home country
  • Your academic record and history in the context of the course you intend to study
  • Your immigration history, e.g. previous compliance with immigration laws and whether you have previously applied for entry to Australia
  • The fact that your proposed course of study is what you might reasonably have chosen given your circumstances
  • The fact that your proposed course is consistent with, and appropriate to, your current level of education

Partner Visas for Australia
This visa is for people who want to enter Australia on the basis of their relationship with their partner. ALL partner visas require sponsorship by the partner and mandate that the partner must be
  • an Australian citizen or
  • an Australian permanent resident or
  • an eligible New Zealand citizen

In case of partner visas, you apply for a temporary and permanent visa at the same time on the same application form.
You are granted a temporary spouse visa if you meet all the initial criteria. This visa remains valid until a decision is made on your permanent visa application. If you continue to meet all legal requirements and if the spousal relationship is ongoing 2 years after application for a temporary visa, a permanent visa may be granted.
You may, however, be granted a permanent visa without having to fulfil the usual two-year waiting period if, at the time you apply,:
  • you have been in a spouse relationship with your partner for 5 years or more, or 2 years or more where there are dependent children of your relationship; or
  • your spouse was granted a protection visa or a permanent visa under the humanitarian program and you were in the relationship before the visa was granted and this had been declared to the department at the time.
All permanent visas are generally valid for 5 years from the date of grant. Beyond this, while you are allowed to live indefinitely in Australia, you will need a Resident Return Visa to re-enter Australia when travelling overseas, unless you obtain Australian Citizenship prior to your permanent visa’s expiry.

Onshore Partner Visas

For temporary partner visa grants, if you lodge your application while you are in Australia, you must be in Australia when the temporary partner visa is granted.
For permanent partner visa grants, if you lodge your application while you are in Australia, you must be in Australia when the permanent partner visa is granted.

Offshore Partner Visas

For temporary partner visa grants, if you lodge your partner visa application while you are outside Australia, you must be outside Australia when the temporary partner visa is granted.
For permanent partner visa grants, if you lodge your partner visa application while you are outside Australia, you may be either in or outside Australia when the permanent visa is granted.

Child Visas for Australia
Child visas - inclusive of all subclasses - are available to: dependent/adopted/orphaned children of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
The child must be under 25, but if aged 18 or over, the child must be a full-time student and dependent on the sponsoring parent.

Child Visa Categories

There are 3 types of permanent child visas: child visa, orphan relative visa and adoption visa.
There is one type of temporary child visa: dependent child visa. Applications for this visa can be made both offshore and onshore.

Permanent Child Visas (Onshore and Offshore)

Child Visa
This visa is a permanent visa that allows a child under 25 years of age to remain in Australia with their parents. The parent must act as sponsor for the child and can also lodge the visa application on behalf of the child.
This visa allows the visa holder to:
  • live permanently in Australia
  • travel to and from Australia for 5 years from the date the visa is granted. After the 5 year period, the applicant will have to either apply for a resident return visa or Australian citizenship, if eligible

Parent Visas for Australia
Parents are eligible to migrate to Australia if their child (natural, adopted or step child) is in Australia and is an Australian citizen or Australian permanent resident or eligible New Zealand citizen.

Eligibility criteria
To apply for parent visa, you must be sponsored by your child, or another eligible sponsor, in Australia. Your spouse and other dependent family members may be included in your application if they meet the specified requirements. To be eligible for this visa, you must pass the Balance of Family test and meet age requirements.

Balance of Family Test
The total number of children and their permanent residence location affects the balance of family test. The test specifies that:
  • at least half of your children should be permanent residents in Australia
OR
  • you should have more children living permanently in Australia than in any other country

Age Criteria
An ‘aged parent’ is one who is old enough to be granted an Australian age pension. However, there is a waiting period of 10 years before you can receive the Australian age pension (unless there is a reciprocal agreement with another country which pays you a pension). Note: The requirement to be an ‘aged parent’ is necessary only for the main applicant for an onshore parent visa.

Parent Visa Categories
Parents can migrate to Australia under two major categories:
  • Contributory parent – this non-permanent visa provides a one- or two-visa pathway to permanent residence. A contributory parent category visa is the higher cost/shorter wait option. The costs of a contributory parent category visa can be staggered over a temporary to permanent 2-visa process provided you apply for the corresponding permanent contributory parent category visa while you are still the holder of a temporary contributory parent category visa.
    This visa has 2 subtypes:
    • Contributory Parent
    • Contributory Aged Parent
  • Parent – this is a direct permanent residence visa. It is a lower cost/longer wait option, and has 4 subtypes:
    • Contributory Parent (Migrant)

Spouse and Relatives Immigration to Australia
Australia Immigration program allows relatives of Australian Citizens and permanent residents to sponsor their spouse or family members into Australia. Read about the criteria for this Australian migration category here.
Relatives of Australian citizens or (eligible) permanent residents do not have an automatic right to residence in Australia.

This includes:
  • a spouse,  a fiancée,  a defacto spouse and  a dependent same-sex partner
  • a child, a parent, a remaining relative or a carer
You must apply for the relevant visa, and be sponsored by the person who is a permanent resident or citizen of Australia.
Most Family Visas also require an Assurance of Support from an Australian permanent resident or citizen - meaning that the assurer must:
  • Lodge a bond with The Commonwealth Bank of Australia
  • Pay a Migration Health Services Charge
  • Undertake to provide sufficient direct or indirect financial assistance
Visitor Visas for Australia
This visa category - inclusive of all its subclasses - is specifically for people who want to visit Australia for a holiday, as tourists, to visit relatives and friends or for other short-term non-work purposes.
To remain longer in Australia than your original visa allows, you are required to obtain another visa, provided your current visa permits you to make a fresh onshore visa application. If you are refused a further visa, you must leave Australia before the expiry of your original visa.

General Skilled Migration Visas
This visa category - inclusive of all its subclasses - is specifically for people who possess any one or more skills listed in the Skilled Occupation List (SOL).
There are certain basic eligibility criteria that apply to ALL General Skilled Migration visas.
 

Basic Eligibility Criteria for General Skilled Migration Visas

To apply for a General Skilled Migration Visa you must:
  • be less than 45 years old at the time of application; and
  • possess a qualification that is equivalent to the Australian bachelor’s degree, diploma or trade qualification; and
  • nominate an occupation from the approved Skilled Occupation List (SOL) ; and
  • have at least 12 months (in the last 24 months) of experience in an occupation from the SOL, preferably the one you nominated, or one similar to it
  • go through an assessment of skills (suitable for your occupation) by an assessing authority before you apply for the visa; and
  • have at least 12 months (in the last 24 months) of full-time work experience in any occupation from the SOL, preferably the one you nominated, or closely related to it; or
  • have successfully completed 2 years of full-time studies in Australia as an international student within 6 months of lodgement of a visa application; and
  • submit acceptable scores of IELTS or OET tests as evidence of your competence in English Language.

General Skilled Migration Visa Categories

The skilled migration visa program has 9 visas and they are categorised into 3 types: offshore, onshore, and onshore New Zealand citizen.

Student Immigration Assessment
Student visas are divided into subclasses based on the principal course of study. The Dept of Immigration associates a certain risk to the issue of student visas, and to this effect base the different student visas on assessment factors - examples include education sector of study and the applicant's country of nationality. Students who have obtained certain Australian qualifications are potentialy able to apply for new categories of permanent skilled visas in Australia on completion of their studies. The different student visa subclasses: (based on the intended studies).

Family Immigration Assessment
There are a number of migration options for fiancés, partners, children, parents and other family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens.
 
Partner Category
Partners and fiancés of Australian citizens, Australian permanent residents or eligible New Zealand citizens may enter and/or to remain permanently in Australia. Partner category migration may apply to:
  • people intending to get married (fiancés)
  • married (de jure) partners
  • de facto partners (including those in a same-sex relationship).
Parent
Parents may be able to migrate to Australia if they have a child in Australia who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Humanitarian Program – Split Family Provisions
For the immediate family members of people granted any permanent humanitarian visa (including Protection and Resolution of Status visas) in the last five years. Question: Do I need a visa to enter and remain in Australia?

Yes, in most cases you will need a visa to enter and remain in Australia.

New Zealand citizens or a permanent resident of Norfolk Island who meet certain requirements do not need a visa to visit Australia for a short stay. Citizens of all other countries must obtain an appropriate visa prior to their travel to Australia.

All transit passengers who need to remain in Australia for more than 72 hours need only a transit visa which is issued free of cost.

Question: How many visas can I apply for at any given time?

There is nothing that can prevent you from lodging more than one visa application at any point of time. However, you are expected to meet the criteria, in respect of each application that is under processing by DIMIA.

Note: An applicable fee has to be paid for each application.

Question: How much will my visa cost?

Visa expenses other than the application cost include Skills Assessment Fee, IELTS Test, Visa Application Charge (payable to the Department of Immigration), Medical Examination, Penal Clearances and nominal documentation charges. It is important to note that the government can change the visa application charges at its discretion.

Visa fees vary across visa types; it is best to check with your migration consultant to arrive at the specific costs associated with your visa application.

Question: How soon can I get a visa?

Processing times for visas vary; it depends on the type of visa. Typical approximate processing times are:

9 to 18 months for most skilled residence visa (including the time required to prepare the application)
3 to 6 months for family, business and temporary work visas
Additional 6 to 12 months for applications requiring professional registration
If my visa is granted, when do I have to enter Australia?

Your visa is stamped with an initial entry date. This is the date by which you must travel to Australia on your visa. If you (and any members of your family included in your application) do not enter Australia by the initial entry date, your visa may be cancelled.

Question: What should I do if the information that I have provided in my application changes?

It is obligatory for you to inform DIMIA in writing of any change in the information that is given in your application form (or was submitted later while your application was still under processing). However, there is no need to intimate any changes in your circumstances to DIMIA if your visa was granted in Australia or if you have arrived in Australia after the visa was granted to you.

Will the immigration authorities or the Australian Embassy help me to prepare my application?

No. This type of service is not provided by the Australian Government. Only an Australian Registered Migration Agent can provide this kind of service.

Question: Can the immigration authorities refuse my application?

Yes. Immigration regulations are very strictly enforced and all applications are assessed on the basis of information and documentary evidence submitted with it. Many applications are refused or delayed due to technical errors on the application or because the supporting documentation is irrelevant or insufficient.

Question: Why do most people use an officially-recognised migration agent?

A large number of visa applicants who apply on their own fail to receive their visas due to application errors, misunderstandings or confusion that commonly arise during the immigration process. I was assessed as eligible for residence by a Migration Agent. If I now apply on my own, without the agent’s help, will my visa be granted?

It is hard to guarantee of success in any visa application even though you may qualify under the immigration policy. In order to be approved, your application must adhere to the prevailing immigration regulations and be submitted with all the appropriate supporting documentation. Many applicants send in incorrect or incomplete applications leading to rejection.

Question: Do I have to send original documents with my application?

No, in almost all cases, certified copies of original documentation will suffice. Please note the copies of the original documents must be certified by one of the persons allowed to do so in your country

Question: Do I have to submit my passport with my application?

You do NOT need to submit your passport to make a valid application but you need to submit a copy of the bio pages of the passport is required as a proof of your identity. You may submit your passport once the application has been finalised and the requested visa is granted. It is recommended that you should provide your passport with 2 unused visa pages when required.

Question: When I migrate, will I lose my current passport?

No. you could retain your current passport and obtain an Australian passport as well, since The Australian Government allows dual-nationality (i.e., the holding of two passports).

However, you must check that your own country of citizenship allows dual nationality, as this right must be reciprocal. If not, you will need to surrender your other passport in order to become an Australian citizen.

Question: Do I have to go through an interview?

In most cases for family residence and some business visa an interview is needed. It is usually conducted over the telephone. We will contact you if we need to arrange an interview.

Question: Is there a medical test?

Yes, a medical test is a standard procedure and passing it is essential to qualify for any permanent visa and most temporary visas offering more than 3 months of residence.

Question: Can I do my medical tests in Australia?

Yes. If you are in Australia temporarily you can approach an office of the Department of Immigration and Citizenship to collect the medical forms and details about approved doctors and radiologists. You (if present in Australia) or the panel doctor, if overseas, should send your sealed medical results, marked with your file reference, to this office or to DIAC directly when completed.

Question: Can I visit Australia while my migration application is being processed?

Yes, provided you obtain a temporary visa that allows you to visit Australia while your other application is being processed. However, you must bear in mind that you need to be outside Australia if you have applied for an offshore visa.

Question: Can I be granted my migrant visa while I am in Australia?

It depends on whether you have applied for an onshore or offshore visa. If the application is made for an offshore visa, you must be outside Australia before the visa is granted. You must depart Australia if you are in Australia for your visa to be granted and this must be evidenced in your passport.

Question: What is the Points Test?

The Points Test is an assessment of a number of attributes such as English, qualifications, work experience, spouse’s skills, occupation, the Australian work experience, proficiency in a community language and occupations currently in demand and many more such attributes.

For most skilled visa subclasses, you need to have minimum pass marks on the points test to be eligible for the visa.

Question: What are pass marks?

There are two grades in the Points Test: pass marks, and pool marks. Pass marks are the qualifying marks for Permanent Residence / Provisional Visas, which change from time to time.

You should check the current pass mark immediately before making an application. You will be assessed against the pass and pool marks that are in effect on the day you file your application.

Question: What are pool marks?

If you have applied for a Skilled Independent Migrant visa or a Skilled – Sponsored Migrant visa and you score below the pass mark, but above the 'pool mark', your application will be held 'in the pool' for up to 2 years after assessment.

You should check the current pass marks immediately before making an application. You will be assessed against the pass and pool marks that are in effect on the day you file your application.

Question: What is the Skills Matching Database?

If you do not make the pass mark, but get pool marks, you can still submit your application in the Skills Matching Database. Your application personal, academic and professional details will be held in this database up to 2 years. Potential Australian employers monitor the Skills Matching Database and could select your application for sponsorship from this database if they find your profile suitable.

Question: What is Electronic Confirmation of Enrolment (eCoE)?

An Electronic Confirmation of Enrolment (eCoE) issued by your Australian education provider is the only accepted evidence of enrolment for processing student visa applications. Depending on your country of nationality and your principal course of study, you may have to undergo a preliminary assessment before an institution issues an eCoE. A copy of your eCoE must be submitted to your local Department of Australian Immigration (DIAC) office before your student visa can be issued.

Question: May I bring my pets with me?

Yes, but it is a fairly expensive procedure as Australia follows very strict quarantine rules and procedures. It also requires extended periods of quarantine abroad which may be quite traumatic for animals.

Does my sponsoring spouse or partner have to remain in the country of residence during processing?

No. However, Australian sponsors are required to provide evidence of their ability to meet the sponsorship obligations.

Question: What is a Working Holiday Visa?

The Working Holiday Maker Visa is meant for persons between the ages of 18 to 30. Australia has entered into reciprocal working holiday agreements with the Netherlands, Japan, Canada, the Republic of Korea, Malta, the Republic of Ireland, the United Kingdom, Germany and countries of Scandinavia (namely Denmark, Sweden and Norway).

As of now there is no provision for citizens of any other country to apply for this Working Holiday Visa. It is likely that some more countries may be added to the list of eligible countries in due course.

Question: What is a Permanent Residence Visa?

A permanent residence visa allows the holder to live and work indefinitely in Australia. You are eligible for state medical care immediately, but must be resident in Australia for two years before qualifying for social welfare assistance (i.e., unemployment benefits) in most cases. You are not permitted to vote as a permanent resident in Australia. This changes when you obtain Australian citizenship provided you meet the eligibility criteria.
